Two independent research teams recently conducted randomized trials to find the answer. The researchers followed 245 school-children aged 6 to 12 years for three months. Supreme Court Refused Ephedra Appeal…The U.S. Supreme Court on Monday refused to consider an Appeal by Nutraceutical International Corporation, which sought to overturn a federal ban on the dietary supplements containing ephedrine alkaloids. The court’s decision, issued without comment, lets stand a 2005 ruling by a federal Appeals court that upheld the Food and Drug Administration’s (FDA) 2004 ban. David Seckman, executive director and CEO of the Natural Products Association commented on the refusal. “Obviously we were concerned about the consequences of the circuit court’s ruling on the risk benefit standard the FDA used in removing ephedra from the market, which is why we filed our amicus brief. As we clearly stated in the brief, we believe congress did not intend for such a standard to be used. But, since the Supreme Court decides to take up only between five and ten percent of cases brought to it, it is not a shock that they’ve decided not to hear it. We should note, however, that the denial of the Nutraceutical petition is not an affirmation by the Supreme Court that they agree with the lower court’s decision,” Seckman said. A three-judge panel of the 10th U.S. Circuit Court of Appeals in Denver late last week overturned a 2005 ruling by a Utah district court that had allowed the sale of low-dosage ephedra dietary supplements containing 10 milligrams or less of ephedrine alkaloids. The appellate decision, which is effective immediately, supports FDA’s original determination that no dosage of ephedra is safe for consumption and means that it is unlawful to manufacture and sell any supplements containing ephedra, even products containing low doses of the herb. The original ban was challenged in a May 2004 lawsuit by Nutraceutical Corp, and its subsidiary Solaray Inc., which said dried whole-herb ephedra sinica - the type of supplement in their products – had been safely used for thousands of years. The U.S. district judge in Utah blocked any enforcement action against Nutraceutical for selling supplements containing 10 milligrams or less of ephedra per daily dose. The Utah District Judge said FDA’s process in banning ephedra improperly shifted the burden of proving product safety from the government to supplement manufacturers. While noting that the Dietary Supplement Health and Education Act of 1994 (DSHEA) categorized dietary supplements as foods and are not, therefore, subject to premarket approval by FDA, the appellate panel found that the Utah district court had interpreted this basic provision to narrowly. A federal Appeals court has ruled that Lane Labs (Allendale,NJ) may be ordered to pay back consumers for selling what the food and drug administration (FDA) considered unapproved new drugs. The three-judge panel upheld the 2004 decision by U.S. district Judge William G. Bassler of the District of New Jersey, which stated that FDA may demand that Lane Labs pay back every consumer who had bought the company’s top selling products—shark cartilage supplements that were allegedly marketed as treatments for diseases including cancer and HIV. The restitution amount is estimated at 109 million. The Appeals court rejected the argument that FDA cannot demand restrictions because the Federal Food, Drug, & Cosmetic Act (FDCA) does not expressly provide for such a remedy. “Whether or not congress specifically contemplated restitution under the FDCA, the ability to order this remedy is within the broad equitable power granted to the district courts to further the economic protection purposes of the statute,” 3rd Circuit Judge Marjorie O. Rendell wrote in an opinion joined by Judges Maryanne Trump Barry and Edward R. Becker. In its Appeal, Lane Labs was supported by an amicus brief from the Washington Legal Foundation (WLF, Washington, DC) urging the court to reverse Bassler’s decision, on the grounds that restitution is not authorized anywhere in the text of the FDCA. Samp, joined by attorney Jeffrey A Lamken of Baker Botts in Washington, DC, argued that the FDCA gives courts the power to “restrain” violations, but does not allow FDA to seek “Backward-looking monetary relief.” WLF argued that FDA, throughout most of its history, never asserted a right to seek restitution until recently, when it began asserting that power in order to have “a big club with which to intimidate manufacturers who might otherwise seek to challenge FDA directives,” including large pharmaceutical companies. However, the court upheld FDA’s authority to seek restitution on the grounds that the FDCA’s grant of authority to restrain violations of the Act should be read broadly to include all forms of equitable relief. HISTORY Ginkgo has achieved unprecedented popularity within the last decade and has become a familiar household term. Because interest in treating diseases like Alzheimer’s has escalated over the last decade, the biochemical capabilities of ginkgo in regard to brain function have been investigated and are still being researched. More often, folks identify mushrooms as food with a peculiar Appeal. But mushrooms' potential impact on health far surpasses their culinary reputation. You don't have to stretch your imagination too far to understand why mushrooms have been much neglected in the modern, Western medical search for plants that can boost health. Unable to make chlorophyll, often dependent on the kindness of other nutrient-producing organisms for their survival, these humble fungal denizens of dark, damp spaces seem to prefer an anonymous existence that is out of sight and out of the consciousness of the scientific mind. However, mushrooms have now assumed a spot in the center of the research spotlight. Because of their potent content of natural chemicals that appear to have a strong influence on human health and well-being, during the past decade mushrooms have been the subjects of intensive studies on how they can be used to reduce the risk of cancer and to treat these diseases. Appropriately, this recent round of research began in a place that has long revered these diminutive organisms: Japan. Japan and other Oriental countries have traditionally recognized the immense value of mushrooms as both food and medicine. Food and Medicine As an ancient Chinese saying notes, "food and medicine share a common origin." And one of the very earliest Chinese medical books, Shen Noug's Herbal (Shen Noug Pen Ts'ao Jing), first noted the extraordinary beneficial effects of eating mushrooms 2,000 years ago, back in the first century. More recently, but still well ahead of Western medical experts, in 1575, Pen Ts'ao Kang Mu (a Chinese compendium of medicinal therapies), written by Li Shi Zhen, outlined the medical benefits of about 20 mushrooms. Nowadays, modern researchers believe mushrooms' usefulness stems from the fact they contain a wealth of antioxidants. But these aren't just any antioxidants. Scientists think that some of these chemicals can potentially drop your risk of cancer, significantly lower blood pressure, help the body fight diabetes, offer protection for the liver, alleviate some of the ill effects of inflammation, lessen the chance of blood clots and help the body's immune system fend off viruses and other microbes. Quite a collection of benefits for these lowly beings! The 10,000-Year Mushroom Through the ages, the reishi mushroom (also known variously as the Mannetake, or 10,000-year mushroom, and the Immortality Mushroom) has been the most popular mushroom in Chinese, Korean and Japanese cultures. The reishi mushroom is frequently depicted in a wide variety of traditional Oriental artwork and even puts in an appearance in Chinese royal tapestries. To some, reishi's power goes beyond the natural and include the supernatural. Originally grown on aging plum trees, reishi is also sufficiently well regarded to be employed by the Japanese as a good luck charm. But you don't have to believe in the supernatural to be superbly impressed with reishi. The beneficial natural substances in reishi include steroids, lactones, alkaloids, triterpenes and polysaccharides. Large Molecules Of these chemicals, polysaccharides (complex chains of sugars) in particular have intrigued researchers looking into the way mushrooms help health. These polysaccharide macromolecules are very large (for molecules) and complex, a complexity that leads researchers to believe they are capable of conveying a huge amount of biological information that help the immune system stop cancer in its early stages. The differences in the benefits of various polysaccharides stems from their intriguing geometrical shapes. Distinctive Differences Even though two distinctive polysaccharides may contain the same number of carbon, hydrogen and oxygen atoms, their three-dimensional differences-the way they are structured and branch off in different directions-can endow them with very different health benefits. Though they all share a basic structure (usually, these molecules consist of a main chain of atoms with various side chains), the slight variations of the side chains changes their effects. By deciphering the microscopic structures of these molecules, scientists think they are beginning to uncover which ones are most effective against cancer. For instance, in isolating a particularly useful polysaccharide called beta-D-glucan from reishi, researchers have found that this substance fights tumors in lab experiments (Chem Pharm Bull 1981; 29: 3611). Maitake Benefits Meanwhile, beta-D-glucan and other extracts taken from the maitake mushroom have also been shown to possess powerful anti-cancer effects in lab experiments (Immunopharm Immunotox; 19:175). In one instance, researchers in the laboratory who were trying out various substances on prostate cancer cells found that applying extracts of maitake results in a kind of programmed self-destruction (apoptosis) of these undesirable cancer cells (Molec Urol; 4:7). In addition, another substance known as maitake d-fraction has been shown to strongly fight cancer in lab animals-in one study, their liver cancer growths were reduced by up to 90% (Ann NY Acad of Sci; 833:204). At the same time, research in China on people has demonstrated that maitake may help reduce tumors and alleviate the effects of leukemia (Alter Comp Ther 12/98; 420). According to A.S. Daba and O.U. Ezeronye (Afr Jrnl Bio 12/03; 672), "Mushroom polysaccharides offer a lot of hope for cancer patients and sufferers of many devastating diseases. " [These substances support]...a fundamental principle in Oriental medicine...[they help] regulate homeostasis of the whole body and... bring the diseased person [back] to his or her normal state." The Activity of Active Hexose Correlated Compound Active Hexose Correlated Compound (AHCC), an extract taken from shiitake and other mushrooms, is a relatively new substance that is also being researched for its anti-cancer benefits. Studies on AHCC began in Japan in the 1990s when scientists looked at how it could potentially help people recovering from liver cancer. In those tests, researchers found that giving people AHCC apparently helped them survive longer. In the future, scientists feel certain that they will uncover even more anticancer uses for mushrooms and the chemicals they contain. A key advantage to these natural substances is their lack of side effects. For instance, in research on an anti-cancer chemical called lentinan, taken from shiitakes, investigators have found that less than one percent of people experience the kind of discomfort that make them discontinue treatment. (This chemical has been used to treat stomach cancer.) But a long list of beneficial mushroom substances are probably still waiting to be discovered. More evidence of mushrooms' benefits: A study of mushroom workers in a part of Japan called the Nagano Prefecture found that these farmers enjoyed a significantly lower cancer rate than other inhabitants of that part of the country. In the rest of Japan, about one in six hundred people dies of cancer. But that rate death rate drops to about one in a thousand for mushroom raisers who eat a diet heavy in mushrooms. John Smith, PhD, from the University of Strath-Clyde, notes that "...increasing evidence [shows] mushrooms offer a remarkable array of medicinally important compounds that have yet to be evaluated by Western medical scientists." No matter how hectic your day, you have no excuses anymore for missing your daily required antioxidants and minerals. And women are particularly prone to this lingering sadness. The good news: Depression doesn't have to linger forever. With proper nutrition, lifestyle changes and a revived outlook, you can break through that fog into a sunnier emotional clime. Women are more likely than men to fall prey to depression throughout their lifetimes, with women being twice as likely as men to experience major depression. While the greatest risk for both sexes falls at midlife, the gender difference appears early; one in ten teenage girls was found to suffer from major depression in one study (International Journal of Behavioral Development 2004; 28:16-25). What's more, childhood depression leaves a person more susceptible to mood problems in adulthood. One reason for the gender difference in depression, according to researchers, is that women tend to dwell on depressed feelings to a greater degree than men. Some scientists believe a family history of depression carries greater weight for women. Others theorize that the inner fluctuations of a woman's monthly cycle can leave her susceptible to stresses emanating from the outer world. Studies indicate that almost three-quarters of all premenstrual women experience some level of mood difficulties (Summit on Women and Depression, APA, April 02), and a woman's hormonal ebb and flow may even make her more vulnerable to seasonal affective disorder (SAD), the kind of depression linked to a lack of natural light. Warning Signs Not surprisingly, many depressed folks feel sad and lethargic, down on themselves and the world. But in some people, depression is marked by agitation and concentration difficulties, or is accompanied by anxiety. Sleep disturbances-either insomnia or excessive sleepiness-often ensue, and activities that used to provide pleasure lose their Appeal. Breaking depression's grip can do more than just lighten your mood-it may help safeguard your health. Origins of Depression The reasons some people are pulled down by depression's undertow while others are able to stay afloat emotionally are complex, but researchers believe common factors link them all. "If you are depressed, there is a 25% chance that a first-degree relative-a parent, child or sibling-is also depressed," says Hyla Cass, MD, author of St. John's Wort: Nature's Blues Buster (Avery). Other factors are physical problems and medication side effects. That's why your first step should be a consultation with your health care practitioner (if your moods are especially dark, seek professional assistance as soon as possible). Life's worries and cares also weigh more heavily on some people than on others. " [N]ot only will certain stressors [adverse events] cause depression as a direct response," notes Dr. Cass, "but they may predispose an individual to future episodes of depression." For example, the end of a relationship when you feel you've lost a lover and been humiliated (and been cheated on) raises your risk of depression (Archives of General Psychiatry 2003; 60:789-96). The Depressed Brain When depression hits, brain chemistry shifts. As a result, chemicals known as neurotransmitters, which relay messages between brain cells, go awry. For instance, a neurotransmitter called serotonin-critical to mood control-may decrease, leaving you feeling depressed, anxious, craving certain foods and unable to sleep. Conversely, "high levels of serotonin are associated with emotional and social stability," according to Dr. Cass. She adds that, in addition, sex hormones such as estrogen and testosterone "affect brain cells directly." Lifting the Fog Because the causes of depression are so complex, leaving the darkness behind generally requires opening up several pathways. Part of feeling better simply lies in believing that you can. Researchers have found that depressed people who feel they have a sense of control over their troubles, do, in fact, have a better chance of recovery (General Hospital Psychiatry 2000; 22(4):242-50). Finding a community of like-minded folks bolsters your capacity to deal with mood problems. In some cases, time spent with a therapist can be a valuable aid in figuring out what's bothering you. On the physical side, losing weight can lift your spirits. Among women with severe obesity-itself a depression risk factor-losing weight has led to depression relief (Archives of Internal Medicine 2003; 163:2058-65). Research also indicates that exercise helps brighten dark moods. Nutritional Uplift A change in diet, along with certain supplements, can also help dispel depression. The first step on the road to emotional recovery: eat a lot of fresh, organic fruits and vegetables, and stay away from overly refined foods with high levels of sugar. Omega-3 fatty acids, the kinds found in flax seed and fish, are essential to proper brain function. In several studies, people who took supplemental omega-3s found significant relief from depression. Key amino acids-the basic units of which proteins are built-serve as starting points for the production of mood-lifting neurotransmitters. In one trial, people who took an amino-acid mix that included tyrosine enjoyed better moods and were happier than people who took amino acids without it (Psychopharmacology (Berlin) Sept 4 2003). Along with amino acids, the body needs the right vitamins-especially members of the all-important B family-to create depression-fighting brain chemicals. In one study, people with depression who took vitamin B12 improved their chances of recovery (BMC Psychiatry 2003; 3:17). Another interesting observation: Vitamin B12 and its partners vitamin B6 and folate are essential to keep a protein called homocysteine (known primarily as a cardiovascular hazard) from reaching excessive levels, and people with high homocysteine are twice as likely to be depressed. This has led some researchers to speculate that folate may help keep depression under control (Archives of General Psychiatry 2003; 60:618-26). Nancy Lazarus is a chef at the famed Moosewood Restaurant in Ithaca, New York, established in 1973 to serve up natural fare with a homecooked, vegetarian emphasis. The bill of fare changes daily at Moosewood, but there's one constant: a cup or bowl of soup, a salad and a thick slice of bread. Some loyal customers have ordered the daily special for 20 years. Nancy Lazarus tells why and offers some of Moosewood's favorite bread recipes: "Cooking is like art; baking is like science; bread is like magic. No matter how much science you apply, you'll never have complete control: It'll do its own thing on some level, which is part of its charm, if you're charmed by that sort of thing. Breads come out differently depending on heat and humidity, the heat of the oven; yeast is a variable that can be slower or faster acting. "There are bread machines, of course, and they work. But they're not as satisfying as the real thing, the kneading, which can be almost therapeutic, and the control over the ingredients to your own specifications. "Bread is not that difficult. Know your own oven, to begin: Good insulation is important and how the heat travels around inside. Convection ovens are a wonderful thing. "There are difficult breads we recommend you buy at a good bakery: baguettes, Italian, French and Cuban that are crusty outside and soft inside. "But focaccia is easy. It's a yeasted bread that's better to make at home than buy because it's so fresh and you can control the toppings. It only requires one slow and one quick rising but you have to be there for a while. "Then there are quick breads that use baking soda or powder, like cornbread. If you want a good meal at home and can make only one thing, make a quick bread. They're satisfying and delicious warm from the oven; and the aroma of bread fills the house. A corn bread with tomato soup for supper is a nurturing meal good for vegans. "Popovers are fast and simple, a middle American 50s treat, but you do need a hot oven and 45 minutes. Also easy to make: sweet breads- carrot, banana, zucchini-and biscuits. "To reduce the fat in denser quickbreads and cakes, use applesauce. It gives body and moistness. "The number of wheat-sensitive people is rising dramatically. A theory I think makes sense is that in the last 30 years the varieties of wheat grown has been reduced to 1 or 2 that are more easily cultivated and harvested with the machinery available. People are overloaded with one type of wheat. "Gluten is the offending substance in wheat and some oats; try rice, tapioca and potato flours, which are denser and more fine and don't produce a good crust. Improve the crust by baking in a preheated cast iron skillet. "Also investigate chickpea flour. You don't make a loaf of bread with it- use it for flatbreads like papadam, which is in Indian cookbooks. And it's good for batter for vegetables. "Spelt is the closest to wheat flour in consistency but some people can be sensitive to it. "Visit a natural food store to check out the flours. The mills sometimes print handouts with recipes and a lot of those are real good, especially for what works with their flour. Or you may run into a baker who will whet your appetite with ideas and recipes. "Bread is the supreme comfort food. It can speak to us, and reassure us. The magic of bread and how it varies: There's something Appealing in that. In today's world, food is predictable, and that's reassuring to some people. At Moosewood, things are always different, and that's good." Claire Criscuolo puts an intensely personal spin on the eclectically ethnic style of cooking at her esteemed vegetarian restaurant, Claire's Corner Copia. That 25-year-old institution in New Haven, Connecticut, reflects her zest for the freshest ingredients, robust flavors and inspired combinations. Claire, a teacher and advocate for healthful cuisine, pours her passion into her breadmaking as well: "Healthy bread is like anything else-it has healthy ingredients. We use the best organic unbleached flour and yeast, pure vanilla, whole eggs (not dried and powdered), whole milk and organic sour cream. You want to use good, fresh ingredients. It's the essence of healthy cooking. "I tell my staff, 'Don't use your soup pot as a garbage pail. Bread is the same. If the ingredients aren't at their freshest for serving, then they aren't right for other uses in the kitchen. "Our bread is very important at Claire's. We make a country white and a honey wheat in a pinwheel loaf-400 a day-and challah for the morning French toast with sauteed bananas or as buns for veggie burgers. "It's not practical to bake bread every day. We let our bread rise several times, punching it down again and again. For the home cook, it's time consuming. Even I'm happy to buy a good loaf of bread. What the Medicine Men Knew by Phyllis D. Light, RH, AHG Energy Times, August 4, 2003 When Europeans first landed on the shores of North America, they were greeted by Native Americans who were healthy and strong, tall and straight-boned, and who generally lived to a ripe old age. Curious and friendly, the Native Americans showed the newcomers how to harvest wild foods and grow suitable crops, and also demonstrated the medicinal use of herbs. The North American indigenous medical traditions evolved into an effective system during its long history, estimated at between 12,000 and 40,000 years. So, herbally, we owe a huge debt to the Native American willingness to share knowledge of North American plants. Many of the herbs sitting on the shelves of natural food stores today were originally found in the medicinal arsenal of Native Americans, including black cohosh, echinacea, goldenseal, pleurisy root, sarsaparilla, red root, black walnut, gravel root and American ginseng. Unique Healing Traditions The number of Native tribes in the United States is estimated at about 500, and each possesses a unique set of healing traditions. While the term "Native American medicine" does not describe a homogenous system of healing, common, underlying principles can be discerned in many of these tribal traditions. Most often, these healing traditions and practices have been handed down in a rich oral tradition from practitioner to practitioner, rarely finding their way into written descriptions. For instance, according to David Winston, a Cherokee medicine priest and herbalist living in New Jersey, "Cherokee medicine is based on connection-body, mind, spirit, family, community and God/Spirit. The Cherokee word for medicine, Nvowti, means 'power.' Anything that has power-water, ceremony, songs, stories, herbs-is medicine." On the other hand, Charles Alexander Eastman, PhD (Indian name: Ohiyesa), comments in his book, The Soul of an Indian, "The Sioux word for the healing art is wah-pee-yah, which literally means 'readjusting or making anew.' Pay-jee-hoo-tah, literally 'root,' means medicine, and wakan signifies 'spirit' or 'mystery.' Thus the three ideas, while sometimes associated, were carefully distinguished." Customized Treatment Native American healing philosophy advocates a customized treatment plan for each person's unique health problems. Consequently, healing techniques focus on the individual, not the disease, although the overall treatment may incorporate well-known ways for relieving the specific discomforts, aches and pains associated with an illness. Native healers employ herbs, ceremony, song and prayer in a manner tailored to each person they treat. Medicinal Sweat A central tenet in many Native American healing traditions is the need to sweat. As a result, Inipi, or Lakota sweat lodges, are located in most areas of the country. Sweating produces many benefits. It opens pores, cleanses the skin, enhances circulation, discourages the growth of bacteria in the body and functions as a detoxification outlet. The skin is well-suited for the elimination of toxins: Experts estimate that during everyday functioning, 30% of the body's wastes pass through the skin. For the Native American, the sweat lodge offers spiritual help as well as physical aid. And the use of sweating is generally not employed as the only treatment but is always accompanied by other therapies such as herbs. Native Americans are not alone in their reverence for using sweating to treat disease. A technique for sweating is fundamental to most traditional medicines, including Ayurveda and Traditional Chinese Medicine. Native American Herbs For native healers, herbs offer physical, emotional and spiritual support. In this tradition, herbs are consumed in teas, tablets or capsules, or are inhaled after being thrown onto the hot stones in a sweat lodge or otherwise burned to release their vapor. Smudging, a ritualized method for bathing a person or object with the smoke from sacred herbs such as sweet grass, sage or cedar, is a way of cleansing individuals, clearing a ritual space or sanctifying ceremonial tools. Each herb in the smudging process is used for a specific reason. Sweet grass grows the spirit, while sage and cedar dispel negativity. Frequently, herbs are taken as preparation for participation in rituals. "Sweet leaf is used as a tea before the sweat lodge ceremony in some Indian communities in South Dakota," notes Matthew Wood, RH, AHG, author of The Book of Herbal Wisdom (North Atlantic Books). "It promotes perspiration, relaxes the nerves, reduces tension and brings harmony and beauty to the participants." Connections The idea that everything in the universe, including people, is connected is a philosophy shared by many tribes. When a medicine person assesses an illness, she not only observes physical problems but also analyzes family and community dynamics. A person's relationship with God is believed to influence health. In this vein, prayers like Mitakuye Oyasin, a Lakota blessing that means "all my relations," Appeals to the interconnectedness of each of us with other people, with the Earth, and with God. "Separation and isolation is one of the leading causes of illness," David Winston says. "There is a connection between everything-within ourselves and outside of ourselves. When we isolate and separate ourselves from our family, our community and from God/Spirit, then we suffer diseases of the spirit. Ultimately, we are responsible for our own spirits-to keep them healthy. "In addition," adds Winston, "from the Cherokee viewpoint, the nuclear family is seen as too small. There are too many single parents working too hard and under too much stress." In a Native American clan-based society, much of this stress is defused with the support of an extended family. Kinship philosophy is a basic part of the Native perspective, a kinship that extends beyond humans to all life, including animals, fish, and birds as well as the Earth itself. Consequently, care of the Earth is an integral part of kinship philosophy. Indigenous cultures have very specific knowledge of ecology and environmental ethics. In the kinship philosophy, damage done by man to the Earth is then reflected back in the body of man by diseases of the body and spirit. Man and his illnesses are seen as part of the ecology of the planet, not a separate, isolated force with the power to control. Modern Ills, Ancient Treatments Winston believes that Cherokee medicine offers the greatest aid to people with chronic illnesses such as chronic fatigue, fibromyalgia and some female reproductive complaints, as well as individuals with stress-related disorders. It can also offer aid to those who are depressed and feel alienated or disconnected from society. Native American medicine can offer balance and healing. Federal Court Overturns FDA Ban on Ephedra at Low Doses by Rakesh M. Amin and Mark Blumenthal A Utah Federal District Court recently limited the scope of a year old Food and Drug Administration’s (FDA) Final Rule1 banning the sale of all ephedrine-alkaloid dietary supplements.2 The Court’s ruling has a limited affect on the ability of companies to sell ephedrine nationally, but is important regarding FDA procedure for creating rules and enforcement powers. Ephedrine alkaloids are found primarily in the controversial herb ephedra (Ephedra sincica Stapf., Ephedraceae). The District Court determined that the FDA’s use of a risk-benefit analysis was against the intent of Congress in passing the Food, Drug and Cosmetic Act,3 which presumes all foods are safe and requires the FDA to prove the existence of a significant or unreasonable risk. The court held that to require food producers to establish a benefit before selling their product places an improper burden on them and was inconsistent with Congress’s intent when it passed the Dietary Supplement Health and Education Act of 1994 (DSHEA) to clearly place the burden of proof of safety of a dietary ingredient on the FDA.4 Secondly, the court determined the FDA had to show by a preponderance of the evidence “a significant or unreasonable risk of illness or injury.”5 Therefore, in order to ban all sales of a given product, the FDA must first prove that the dosage amount in the product presents an unreasonable risk.6 Prior to this ruling, the FDA was not required to consider dosage size before banning a substance. This ruling has limited effects at the moment since the FDA may Appeal this decision. Additionally, the ruling has no effect on the laws of several states (including California, Illinois and New York) which have banned all sales of ephedrine alkaloids in dietary supplements. The ruling also only applies to products containing 10 mg or less of ephedrine alkaloids per daily dosage. Any product exceeding that amount is still banned and will continue to be enforced under the FDA rule.7 The court, in its ruling, specifically precluded the FDA from taking any enforcement action against Nutraceutical Corporation, the company that filed the lawsuit, for its sale of products containing 10mg or less of ephedra and for the FDA to consider further rulemaking “consistent with this Order”.8 However, the court did not specifically instruct the FDA to refrain from taking enforcement action against other brands containing less than 10mg of ephedrine.9 As such, companies considering launching new products containing ephedrine alkaloids are advised to do so carefully. Nutraceutical Corporation president Bruce Hough was cited in The New York Times as saying that the company’s reason for filing the suit was not based on ephedra and that his company had no plans to begin marketing ephedra supplements in the near future.10 Hough was quoted as saying, “We filed it [the lawsuit] because the FDA established rules that could cause problems to the rest of our business.” Hough was referring to the legal basis upon which the FDA banned the sale ephedra. He told the American Botanical Council that the FDA was applying a drug standard of risk vs. benefit to herbs and dietary supplements – technically foods under the law. [Hough B. Blumenthal, Apr. 27, 2005.] His company filed the lawsuit in an attempt to deter FDA’s new procedure for creating what he considered arbitrary rules which contradict the plain meaning of existing federal law (DSHEA). The American Herbal Products Association (AHPA) issued a statement on April 26 clarifying its policy on the sale of ephedra in dietary supplements.11 AHPA has notified all its members that at this time it is the organization’s policy that none of its members should be selling low doses (10 mg or less) of ephedra in dietary supplements until the FDA has clarified its position on the Court decision. At this time it is not clear whether FDA plans on Appealing the decision or will implement the new policy set by the Court. The court decision does not affect the sale of the herb ephedra in traditional formulations intended for use that is consistent with traditional uses, e.g., pulmonary complaints, and are dispensed by licensed healthcare practitioners. As might be expected, court’s decision has stimulated a new round of media and congressional criticism of the relative safety of herbs and dietary supplements as well as DSHEA. For example, a highly critical article by Chris Mooney was posted on the website of the American Prospect on April 25.12 The Prospect is relatively influential in Democratic and progressive political circles in Washington. The article uses language such as the court decision is a “scandal” and a “disturbing ruling”, refers to DSHEA as “a terrible law” and a “peculiar and misguided law” and the “wrongheaded standards encoded in the DSHEA”, and repeats the often-cited media mantra about “unregulated herbal supplements” and that the “FDA has been hamstrung and effectively rendered impotent.” More information regarding the sale of ephedrine products or FDA regulations in general is available from the law offices of Rakesh M.
