Although the Washington state legislature has allowed hemp to once again be grown in the state, there are still some questions and uncertainties about growing the product. For now, those growing hemp are doing it for research purposes to monitor what the future growers will need it to do in order to create an industrial hemp harvest. Despite the four different types of licenses being granted, there is still some caution because of the plants close relationship it to marijuana. Hopefully some restrictions will change and beneficial aspects of the hemp can be produced, such as CBD oil.

Acne Skin

Acne skin is normally oily and associated with blackheads, pimples and spots. It is not normally applied to serious acne conditions, being mostly associated with skin which is generally 'spotty', as opposed to mostly clear. It is debatable whether acne skin is any different from oily skin which also tends to be covered with spots and pimples, and the treatments for acne skin are no different to those for oily skin: these are Accutane, antibiotics and topical treatments such as face washes and scrubs.

Contrary to what you may have heard or read, acne has nothing to do with your diet - eating fatty foods or chocolates do not cause acne, which is caused only through production of excess sebum, or skin oil, by the sebaceous glands.

Irrespective of your skin type your physician will determine the best treatment that is appropriate for your particular case of acne. This may be different for individuals and may or may not change according to skin type. Antiseptic face washes or scrubs may be appropriate for some acne cases, Accutane might be the best treatment for others, while a course of internal antibiotics such as tetracyclines may be deemed appropriate for yet other cases.

Treating acne has three distinct phases:

1. Removal of the blackheads and lesions. The removal of lesions can also involve a degree of scar removal, although that is another topic. Black heads, whiteheads and other papules can be treated by the use of facial cleansers and scrubs. They should not be squeezed since the puss inside them could be forced deeper into the skin and so lead to a more generalized infection.

2. Treatment of the bacterial infection. The typical symptoms of acne, the papules, whiteheads and blackheads, are caused by bacterial infection of the plug of sebum and dead skin cells within the sebaceous follicles. The general treatment for such infections is antibiotics, both topically and internally. Tetracycline has already been mentioned as a common internal antibiotic, and several forms of antibiotics are used in facial scrubs of which peroxides and benzoates may perhaps be rather severe for dry and sensitive skins.

3. The third phase is treatment of the causes of excessive sebum production. This is generally not entirely treatable since it is predominantly due to excessive hormonal activity at certain times of your life such as puberty, menstruation, pregnancy and menopause. However, your physician may offer treatments such as the contraceptive pill which should be used with care.

Other treatments include agents that aid desquamation, so preventing the irregular shedding of skin cells that lead to the mixture of sebum and dead skin cells that form the plug that is so easily affected by bacterial infection.

Together these three stages of acne treatment can, if not prevent the condition, certainly reduce its extent and have less of an effect on your skin, particularly if you are the off the oily skin type. Doctors will take your skin type into consideration when determining the best acne treatment for you, although all generally this will only be with respect to topical treatments: treatments that are applied to the surface of your skin.

There are also a number of herbal treatments which are used in the treatment of various stages of acne, and many sufferers find these equally as effective as the more traditional forms of topical applications as prescribed by physicians. Guarana has large leaves and clusters of flowers and is best known for its fruit. The fruit of this plant is about the size of a coffee berry. Similar to other plants producing caffeine, the high concentration of caffeine is a defensive toxin that repels pathogens from the berry and its seeds. NOW Takes Top Honors in 3 Distinct Categories On March 24th, 2009 a large contingent of individuals from the Natural Products Association (NPA) visited Capitol Hill during Natural Products Day to lobby Congress on behalf of our industry. Among this contingent were seventeen individuals from the state of Illinois, including three from NOW Foods – President Al Powers, Mike Richard, and Truth Advocate Neil Levin. NOW had two goals during Lobby Day; to meet and lobby Illinois legislators and their staffers on important industry matters, and to obtain contact information for House and Senate lawmakers and their staff for the purpose of extending an invitation to visit and tour our Bloomingdale, Illinois headquarters.

During the day Illinois representatives visited the offices of Illinois senator Richard Durbin and Illinois congressman Bill Foster, and visited with a representative of newly appointed Illinois senator Roland Burris. In regard to legislation, members of the Illinois contingent supported an update to the national school lunch program, which was last revised in 1979, and renewed their support for the Dietary Supplement Health & Education Act (DSHEA), the main body of laws regulating our industry. They also warned Illinois lawmakers that the possible dissolution of the Food and Drug Administration (FDA) into separate Food and Drug agencies could potentially lump natural products regulation together with drug regulation, despite the vastly superior safety record of natural products and dietary supplements.

They also presented information on a number of studies that showed the potential for over $20 billion in healthcare savings over a five year period if consumers were to take certain supplements, including calcium and vitamin D to maintain bone health, lutein and zeaxanthin to support visual function, folic acid to protect from birth defects, and more. Lastly, representatives from NOW Foods opposed new regulations that could hurt businesses that, like NOW Foods, are responble for increasing American exports and creating new jobs for Americans during a protracted economic downturn.

Even though there was no immediate commitment from our representatives in Washington on the key issues discussed, we feel that this Lobby Day was successful in building more personal relationships with our elected officials, and in helping them to understand our industry’spassion and commitment to promoting optimal health for all Americans through the use of safe, high quality natural products.

Colds are usually restricted to the nose, throat, and surrounding air passages and usually do not bring fever, chills, or the more severe symptoms that often associated with the flu. Unfortunately, the duration of symptoms of a cold is usually longer than that of the flu, as it sometimes lasts several weeks at a time.

Viruses are the cause of the majority of symptoms that are found along with a cold or flu. They are involved in the cause of these symptoms in several ways. First of all, some of the symptoms of a cold are caused by the body’s own response to the infection. Some of these symptoms include cough, fever, runny nose, sneezing, and watery eyes. Garcinia Cambogia is found naturally in India and parts of Asia, and also on the Pacific coast of South and Central America all the way from Peru up to Mexico, and likes a humid forested environment. Also known as Brindall berries, garcinia is believed to act as an appetite suppressant and allows you to lose weight by diminishing your desire for food.

The Malabar tamarind, as it is also known, is about the size of an orange resembling a small pumpkin, and an extract from the fruit and rind is used in several weight loss products. The health risks presented by synthetic diet pills render a natural product extremely attractive were it to be effective. So can Garcia curb your appetite? What is the scientific evidence for it, and what biochemical route would it take?

Although tests on animals have been very positive, human results have been inconsistent. In some double blind tests using a placebo, weight loss was up to three times that of the control, but in others there was no apparent difference between those taking garcinia, and those given a placebo. However, doubts have been raised of the validity of some of the negative tests, so what does science tell us?

The active ingredient in the cambogia extract is hydroxycitric acid (HCA), which is a powerful inhibitor of ATP citrate lyase, an enzyme that catalyzes the reaction between citrate and Coenzyme A to Acetyl CoA and oxaloacetate. Since the acetyl CoA is necessary in the synthesis of fatty acids and lipogenesis (the conversion of glucose to fatty acids), then anything that inhibits the biosynthesis of acetyl CoA must help to reduce the amount of fat stored in your body.

By inhibiting this reaction, that occurs outside the mitochondria so is not a direct part of the Citric Acid Cycle, HCA should theoretically suppress the formation of fats from carbohydrates, reduce food intake and thereby induce weight loss. But that is not the only mechanism.

A study at Georgetown University in Washington found that after 8 weeks of taking the garcinia extract, there was a 5.4% reduction in body weight and body mass index, and a significant reduction in low density lipoproteins (LDL) and triglycerides with an associated rise in high density lipoproteins (HDL). This is good news for those suffering from high cholesterol levels, since the LDL lipoproteins are those that carry cholesterol to the major blood vessels, and which when oxidized by free radicals deposit fatty plaques on the artery walls. These plaques constrict the arteries and the resultant atherosclerosis can lead to cardiac problems and strokes. HDL lipoproteins carry cholesterol back to the liver for destruction, and is known popularly as ‘good cholesterol’.

The studies also indicated modifications to certain indicators of the status of fat deposits in the body and of appetite modifiers in the brain. In this respect they found 38% decreases in serum leptin and increases in serotonin levels of 44%, and the excretion of fat metabolites in the urine increased from between 32% and 104%.

These are significant findings, and further research has indicated that HCA helps to suppress appetite. Serum leptin is an indicator of the level of fat stores in the body, and as the leptin levels in the blood reduces, the hypothalamus is given an instruction to increase the appetite so as to increase the fat levels again. However, it is believed that HCA possesses leptin-like properties, and this signal is either not generated or is modulated.

The increase in serotonin has the same effect. It is known that serotonin controls the appetite, although the exact mechanism has not yet been established. What is known is that serotonin activates certain neurons and melanocortin-4 receptors (MC4R) in the brain, that not only curb appetite but also block the effect of other neurons that would normally increase appetite by blocking the effect of MC4Rs.

This is how the banned anti-obesity and serotonin inciting drug Fen-Phen operated, and it appears that the hydroxycitric acid in garcinia cambogia extract acts in a similar, but safer, way. The problem with drugs such as Feb-Phen was that they created cardiac problems which could be dangerous to obese people whose hearts might have been weakened.

However, now that the biological pathway by which serotonin controls weight is believed to be known, if not fully understood, the way is becoming clearer as to how safer weight loss pills, acting through appetite suppression, might be developed. It also provides a valid scientific explanation for the effect of garcinia cambogia extract which might in itself prove to be that safer way.

The biochemistry supports the evidence of its effect on those wanting to lose weight, and also bolsters the claims that those tests and trials found to be negative were in some way flawed. Until the full chemical pathway is understood, the factors that can lead to flawed tests are unknown, although one could be the use of excessive fiber in some trials that could reduce the effect of the extract.

One of the effects of HCA is to limit the ability of your body to convert carbohydrates into fat (the Acetyl CoA inhibition mentioned above). That, combined with suppression of your appetite and a higher rate of thermogenesis, prevents the body from storing excess carbohydrates as fat. Instead you will have increased energy levels, so you should exercise to use this up while taking garcinia extract. For this reason it is popular with athletes and bodybuilders seeking an energy source that has not yet been banned from sport.

Although diet pills based on the same principle had side-effects and could make the user feel on edge, there are none known with garcinia. However, it is possible to reduce the absorption of some essential nutrients due to appetite suppression, so do not exceed the recommended dose. An excessive amount can also led to gastric discomfort, but none of these effects have been noted when the recommended doses have been adhered to.

However, if you are diabetic, pregnant or a nursing mother, you should consult with your physician or health professional before taking the extract. Garcinia Cambogia presents no specific risk to such people, and this warning should be given for all non-prescriptive treatments that your physician might be unaware of you taking.

Recently, the Natural Products Association has experienced a flurry of activity on the legislative front. One month ago, Natural Products Association members went to Washington, D.C. to meet with their representatives and discuss legislation important to the association and the industry. Many who could not visit Washington in person were part of our "virtual march" on Washington that delivered e-mails, petitions, and videos to Congress on the importance of natural products. Natural Products Day was a great success, boasting higher than ever attendance at our evening Congressional reception, and resulting in additional co-sponsors for S. 771, the Child Nutrition Promotion and School Lunch Protection Act sponsored by Tom Harkin (D-Iowa). The bill now boasts co-sponsorship of more than a quarter of the Senate. Its companion bill in the House of Representatives, H.R. 1363, sponsored by Lynn Woolsey (D-Calif.), has gained an additional five co-sponsors as the result of Natural Products Day meetings and now has 140 co-sponsors. These bills continue to build momentum, thanks to your support.

More recently, the Natural Products Association urged supporters to contact their legislators to include an amendment to the "Farm Bill" allowing food stamp recipients to purchase dietary supplements. This provision was similar to free-standing bills that have been introduced in the current and previous Congresses by Sens. Harkin and Orrin Hatch (R-Utah) and have earned the association's support. Although the amendment advanced further than other versions in previous sessions, it did not make the final Farm Bill, which was reported out of conference today. The good news is that the Farm Bill did contain significant increases in nutrition programs and increased funding for organic farming, another supported goal of the Natural Products Association. Because of the strong effort of our supporters on the amendment's behalf, the bill was placed on Congress's radar screens and has greatly improved the chances as stand-alone legislation, S. 770, the Food Stamp Vitamin and Mineral Improvement Act, of seeing passage. We will continue to ask for support on this important bill as this legislative session progresses.

In addition, the Natural Products Association has been leading the fight to protect Dehydroepiandrosterone (DHEA), and to keep this important, safe, and effective supplement available to elderly consumers. The same players behind S. 762, which would wrongly classify DHEA as an anabolic steroid, proposed S. 2470 in late 2007 as a misplaced reaction the release of the Mitchell Report, which chronicled the abuse of steroids by professional baseball players. Although DHEA has no performance enhancing attributes, this bill was proposed to limit the access of minors to DHEA. The Natural Products Association and its supporters have worked hard to inform Congress of the benefits of DHEA, and that it is not an anabolic steroid and should not be classified as one. We have been able so far to prevent any movement on the bill, but the association continues to monitor its progress and make sure that this supplement remains accessible to the seniors who need it most.

Thanks to your help, the Natural Products Association continues to have an active presence on Capitol Hill that is felt by legislators. Arguments made by the Environmental Protection Agency, which regulates plant produced pesticides, tell us not to worry about the thought of consuming toxic pesticides. Instead, they say that the pesticides used, Bt, are produced naturally from a soil bacterium which has a history of safe use by organic farmers who have used the solution for yeas as a method of insect control. Genetic engineers simply remove the gene that produces Bt and insert it into the DNA of corn and cotton plants, making the plant do the work, instead of the farmer. They also say that the Bt toxin is quickly destroyed in our stomach, and even if it survived would not harm humans or any other mammals. However, these arguments are solely that, arguments, which are unsupported and refuted according to a lot of research.

When a study was done, spraying natural Bt over areas in Vancouver and Washington State for months, about 500 people reported reactions, mostly those being allergy or flu-like symptoms. Six of those people had to go to the emergency room, while workers who applied the Bt sprays reported that their eyes, nose, and throats were irritated. Similarly, farmers who were exposed to liquid Bt said that they had reactions such as infection, ulcers on the cornea, skin irritation, burning, swelling, and redness. One woman even reported fever, altered consciousness, and seizures when she was accidentally sprayed with Bt. This proves that the statements of Bt doing no harm on humans is extremely false. As for being destroyed in the digestive system, studies on mice disproved this as well. Results of these, and other, studies showed that plant-produced Bt is always active and much more likely to trigger an immune response than the natural version.

Additional studies in 2005 reported by medical investigators in India found that hundreds of agricultural workers are developing severe allergic reactions when they are exposed to Bt cotton. This exposure includes picking cotton, loading it, cleaning it, or simply leaning against it. Some people that work at ginning factories must take antihistamines daily in order to go to work. These reactions are only trigger with the Bt varieties and the symptoms are virtually identical to those that were described by the 500 people in Vancouver and Washington who were sprayed with Bt.

Another study was done on the basis that Bt-toxin is produced in GM corn and can be eaten intact. It is also in pollen which can be breathed in. Therefore, a village of Filipino people were studied in 2003 when an adjacent Bt cornfield was pollinating. 100 of these people were stricken with disease which included symptoms such as headaches, dizziness, extreme stomach pain, vomiting, chest pains, fever, and allergies, along with respiratory, intestinal, and skin reactions. The symptoms first appeared in those that were living closest to the field and then progressed to those further away. When the same corn was planted in four other villages the following year, the same symptoms returned in all four areas only during the time of pollination.

All of these studies confirm that GM crops engineered to produce built-in pesticides provoke a great variety of immune responses. Allergic reactions are a defensive and often harmful reaction from the immune system to an external irritant that occur when the body interprets something foreign as harmful and offensive and acts accordingly. Since all GM foods have something foreign and different, it is easy to see why the body would react in such ways. As the GM foods arise on the market place make sure you scan each label to make sure you are not buying a GM vegetable of fruit. Check every label this way you will not be stricken with debilitating symptoms that may prevent you from going to work. Always say NO to GM foods and support your organic foods store.

Apple Polyphenol (procyanidin B2 and C1) - phytochemical concentrate found in the skin of unripe apples that acts as potent antioxidant. In the most exciting development yet, Japanese researchers released a new study late in 2005. Once again, procyanidin therapy was proven successful in regrowing hair in subjects with male pattern baldness. The new study, published in the Journal of Cosmetic Dermatology, confirmed the findings of earlier studies, showing clear improvement in the number of hairs and the density of hairs in the treated area. Building on the success of earlier trials, the study was extended to 12 months in the procyanidin group, and proved that longer term procyanidin therapy was even more successful than prior 4 and 6 month trials.

If we first examine the role of androgens, specifically dihydrotestosterone (DHT), we find that this hormone has been thought to slowly "choke" the growth of the hair follicle by inhibiting the function of an enzyme in the hair follicle called adenylate cyclase. Suffice it to say that when DHT concentrations remain high in the scalp, we see terminal (thick, coarse) scalp hair become reduced to vellus hair (fine, thin peach fuzz). On March 04, 2001, at the American Academy of Dermatology Meeting in Washington DC, scientists presented the findings of a study done on 1% ketoconazole shampoo which had good news for hair loss sufferers. In the study presented, one hundred male volunteers with mild to moderate dandruff and somewhat oily scalp, were using in a double-blind fashion either a 1% ketoconazole shampoo or a 1% zinc pyrithione shampoo, 2-3 times a week for 6 months.

Analysis of the different parameters set up in the study shows that the hair diameter gradually increased with ketoconazole use (+8.46%) over a 6 month period, whereas the diameter showed a trend to decrease with zinc pyrithione use over the same period (-2.28%). The sebum excretion rate was reduced with ketoconazole (-6.54%) while it increased with zinc pyrithione (+8.2%) over the same period of time. The number of hairs shed over a 24-hour period was reduced by 16.46% with ketoconazole and 6.02% with zinc pyrithione after 6 months. Finally, the percentage of hairs in the anagen phase increased by 6.4% and 8.4% respectively during the study.

The results are similar to a previous study done on 2% prescription strength Ketokonazole where it was shown that use of 2% ketoconazol yielded an increase in hair shaft diameter similar to what was achieved by the control group using 2% Minoxidil and a non-medicated shampoo.

Rooibos - Rooibos or Red Bush Tea - a hardy shrub indigenous to the North Western Cape of South Africa – is an exciting new botanical ingredient with potent antioxidant and anti-inflammatory properties well documented in medical literature. In alternative medicine Rooibos is often prescribed for nervous tension, allergies, stomach and digestive problems. Results from an independent study also showed a significant improvement in hair loss. Studies were initiated at an independent laboratory (Dermascan, France) to study the effect of the use of Rooibos in a hair lotion on a group of healthy persons who were suffering from the problem of hair loss. A 90 day trial was conducted comparing a hair lotion containing Rooibos with a placebo lotion.

After 90 days results showed a significant increase of the hair growth in the lotion containing Rooibos compared with the placebo. An increase in the hair growth was observed with 89% of the volunteers with no undesirable reactions (irritation or allergy). The participants were next asked to fill in a questionnaire. When the results were tallied, 67 percent rated their hair loss as zero or low, 78 percent saw a low to medium improvement, 45 percent saw a low to medium regrowth of hair, and 63 percent considered their hair had become smoother and shinier.

Conclusion: results show that most of the volunteers had a remarkable improvement in both the increase of hair growth and the decrease in hair loss.

Hair is composed primarily of proteins (88%). These proteins are of a hard fibrous type known as keratin. By the time you read this Washington Update, Senate Bill 3546 (S.3546), “The Dietary Supplement and Nonprescription Drug Consumer Act,” may have already passed the Senate. As S.3546 advances to the House for implementation, non-casual Adverse Event Reporting (AER) looms on the horizon. This bill will wrongfully associate safe and beneficial dietary supplements with millions of adverse events that supplements did not cause. As S.3546 targets supplements, it ignores foods that have been linked to millions of annual adverse events—calling into question whether this bill is truly designed to keep us safe. With our right to take vitamins hanging in the balance, we must take immediate action in the House to head off S.3546 as the pass.

S.3546 offers no protection to American people. Instead, this bill appears to inexplicably punish supplement manufacturers and those who choose nutrition as a path to health and well-being. S.3546 attacks our fundamental freedom of choice through guilt by association and will destroy our core freedom to decide how and through which means we pursue health.

Along the way to revoking our health freedom, S.3546 will impose unreasonable reporting requirements that will drain supplement manufacturers’ resources and finances until they collapse. The non-causal AER that S.3546 proposes will unleash a wave of junk lawsuits that will deliver the fatal blow to the supplement industry—making trial lawyers rich while America’s health sinks in the murky waters of malnutrition and sickness.

S.3546 proposed AER for supplements is based on association and not causation—a baldy misguided approach under which supplements will be reported for adverse events even if they did not cause, and had nothing to do with, those adverse events.

Non-causal AER encourages the scourge of our society-junk lawsuit purveyors and ambulance-chasing trial lawyers-to continue exploiting out legal system for their own selfish gains. If S.3546 is implemented, this scourge will blame vitamins for everything from acne to obesity. Americans are already paying for the actions of junk lawsuit scammers, facing ever increasing insurance premiums. With S.3546, Americans will pay an even greater price for junk lawsuits-losing their freedom, their health and their very lives when health-enhancing nutrition is taken away.

Why are safe, natural supplements being singled out, anyway? Dietary supplements rarely, if ever, cause any serious adverse events. The centers for disease control (CDC) estimate that foods cause approximately 76 million illnesses, 325,000 hospitalizations and 5,000 deaths in the United States each year. Despite these figures, no one in Washington is proposing AER for foods. That S.3546 does not include foods is incriminating; it suggests that public safety is not the bill’s ultimate goal. Washington—Jointly, the Council for Responsible Nutrition (CRN), American Herbal Products Association (AHPA) and National Nutritional foods association (NNFA) issued a statement in November reaffirming and calling for responsible use and marketing of dietary supplements, and encouraged consumers and retailers to avoid supplements purporting to prevent or treat the avian flu.

“The dietary supplement industry is keenly aware of public concern regarding avian flu and of the desire of the public to protect itself against this recent health epidemic, which can cause serious illness and, ultimately, death,” the statement read. “We do not believe any dietary supplements have been specifically shown to prevent or treat avian flu.”

The trade coalition futher issued the following unified guidance for marketers, retailers and consumers:

  • Marketers and retailers of dietary supplements are urged to refuse to stock or sell any products that are presented as preventing, treating or curing avian flu.
  • Marketers and retailers should refrain from promoting any dietary supplements as a preventive, cure or treatment of avian flu; and
  • Anyone who believes they may have avian flu or may have come in contact with the virus should immediately contact a health care professional.

“Millions of Americans value dietary supplements because they can enhance general immune function and disease resistance,” they noted. “however, therapies for prevention or treatment of avian flu should only be recommended by a qualified health care professionals or public health authorities.”

By Greg Arnold, DC, CSCS, December 20, 2005, abstracted from “Dietary folate improves age-related decreases in lymphocyte function” in the January 2006 issue of the Journal of Nutritional Biochemistry Recent research has elucidated health-promoting roles for folic acid beyond that of insuring normal development of the fetus. In addition to helping decrease neural tube defects,1 folic acid can also help treat inflammatory bowel disease 2 improve memory 3 and help decrease an amino acid in the body, homocysteine,4 that increases heart disease risk.5 Now a new study 6 has found another way that folic acid can help us age more gracefully: by helping strengthen our immune system. Recognizing the importance of nutrition in the overall health of the immune system 7 and knowing that certain types of immune system cells, called “T cells”, decrease with age,(8,9) researchers fed 11-month-old and 23-month-old male rats either a control diet or a diet fortified with 35.7 mg per kg of folic acid for three weeks. Researchers found “a significant” increase in immune system strength in the folic acid group, specifically that of increased T cell levels, other immune system proteins called IL-2, IL-4, and anti-cancer proteins called “tumor necrosis factor”. A federal appeals court has ruled that Lane Labs (Allendale,NJ) may be ordered to pay back consumers for selling what the food and drug administration (FDA) considered unapproved new drugs. The three-judge panel upheld the 2004 decision by U.S. district Judge William G. Bassler of the District of New Jersey, which stated that FDA may demand that Lane Labs pay back every consumer who had bought the company’s top selling products—shark cartilage supplements that were allegedly marketed as treatments for diseases including cancer and HIV. The restitution amount is estimated at 109 million. The appeals court rejected the argument that FDA cannot demand restrictions because the Federal Food, Drug, & Cosmetic Act (FDCA) does not expressly provide for such a remedy. “Whether or not congress specifically contemplated restitution under the FDCA, the ability to order this remedy is within the broad equitable power granted to the district courts to further the economic protection purposes of the statute,” 3rd Circuit Judge Marjorie O. Rendell wrote in an opinion joined by Judges Maryanne Trump Barry and Edward R. Becker.

In its appeal, Lane Labs was supported by an amicus brief from the Washington Legal Foundation (WLF, Washington, DC) urging the court to reverse Bassler’s decision, on the grounds that restitution is not authorized anywhere in the text of the FDCA.

WLF attorneys Daniel J. Popeo and Richard A. Samp, joined by attorney Jeffrey A Lamken of Baker Botts in Washington, DC, argued that the FDCA gives courts the power to “restrain” violations, but does not allow FDA to seek “Backward-looking monetary relief.”

WLF argued that FDA, throughout most of its history, never asserted a right to seek restitution until recently, when it began asserting that power in order to have “a big club with which to intimidate manufacturers who might otherwise seek to challenge FDA directives,” including large pharmaceutical companies. However, the court upheld FDA’s authority to seek restitution on the grounds that the FDCA’s grant of authority to restrain violations of the Act should be read broadly to include all forms of equitable relief.

FDA cannot be allowed to get away with this power grab,” said Samp after reviewing the Third Circuit’s decision. “The American economy suffers, and public safety and health are jeopardized, when FDA seeks to exert power beyond its authority, upsetting to delicate balance struck by Congress in its attempt to both preserve the public welfare and encourage valuable pharmaceutical innovations.” He added that WLF has pledged to continue to litigate the issue and to support Lane Labs in any further appeals the company may file.

MAIN PRODUCT FEATURES: Psyllium is a true dietary fiber, even though it is classified by some as a laxative or mucilaginous fiber, and is a convenient way to increase intake of dietary fiber because of its high mucilage content. This bulking agent swells considerably when added to liquid, which can help to increase gastrointestinal transit time. This bulking action and increased transit time can play an important role in maintaining healthy gastrointestinal function.3-9 The FDA allows a health claim for products like psyllium husk that provide significant amounts of soluble fiber: Diets low in saturated fat and cholesterol that include 1.7 grams of soluble fiber per day from psyllium husk may reduce the risk of heart disease. Trace Minerals and Migraines

An increasingly large amount of disease today may be attributable to deficiencies in the supply of trace minerals in our diets.1 How can this be the case when the availability of food in our country is unprecedented, with a supermarket on every corner? These deficiencies do not stem from a lack of quantity of food, rather they stem from the quality of food. Trace minerals can be found mainly in whole, unprocessed foods such as vegetables and fruits. Unfortunately, the large majority of fruits and vegetables found in supermarkets today are nutritionally devoid of these minerals, largely in part to the high-yield farming practices in this and other countries.

The mineral content of food is mainly dependent on the amount of minerals found in the soil in which it is grown. Current farming practices leave soils with less than optimal amounts of these minerals, especially the less common trace minerals. As a result of this, our food supplies leave us at risk for deficiencies of these very important substances. Because of this situation, it is essential that every person now supplement their diet with trace minerals in order to avoid the many diseases that are attributable to this scarcity. A lack of vital nutrients leaves the body unable to function fully, leaving it vulnerable to disease.

Trace minerals have numerous roles. Oftentimes, because these minerals are found in such small quantities in the body, scientists and physicians have paid little attention to their importance in health and disease prevention. However, with the advent of improved science and the recognition of the efficacy of natural medicine, we are beginning to understand how vital these elements are to our health. Trace minerals, in a sense, are akin to the numerous tiny nails, nuts, and bolts that hold a house together. At first glance, a home is made of much more than these items. However, if they are slowly removed and never replaced, the house will continue to sag and finally fall apart. So it is the same with the smallest building blocks of our bodies. Trace minerals are important in the proper functioning of enzyme systems, nerve conduction and muscle function, assisting with transfer of nourishment into cells, providing the framework for tissues, and regulation of organ functions. These ‘behind the scenes’ functions are not possible without a constant, adequate supply of minerals. Even with the many multivitamin and mineral supplements available, most of these products fall short because they do not contain large enough amounts of the trace minerals that are so important to health.

Physicians that specialize in natural medicine are some of the biggest proponents of trace mineral supplementation. This type of physician is attuned to the many subtleties of the functions of the human body, and oftentimes addresses health issues with nutritional therapeutics in an attempt to bring the body’s health back into balance. This process of balance, also known as homeostasis, occurs quite wonderfully all by itself, as long as the body has the proper fuel and building materials. Unfortunately, physicians are seeing more and more diseases, which can be attributed to the body’s inability to achieve this balance. This trend towards ill health is directly related to the dearth of nutritional value in our diets today.

However, practitioners of natural medicine are very excited with the many dramatic turn-arounds toward health that many of their patients have experienced with the use of mineral supplementation. A common example of this is the treatment of migraine headaches with magnesium. Recent statistics suggest that 18 percent of women and six percent of men suffer from migraine and those numbers are increasing.2 The Centers for Disease Control reported a 60-percent increase in the disease from 1980 to 1989.3 Migraine headaches occur when the blood vessels in the brain spasm and constrict. Soon after this constriction occurs, the blood vessels then reflexively open, or dilate. When the vessels become dilated, they occupy more space in the brain, activating nearby pain receptors. It is speculated that an imbalance of mineral stores in the body can lead to this spasm of the blood vessels. Many researchers have suggested magnesium plays an important role in migraine attacks. The activities of magnesium in the body include preventing blood vessel spasm, inhibiting blood clotting, and stabilizing cell membranes, all of which are involved in migraine develoment4. Magnesium concentration exerts an effect on neurotransmitter production and receptors, pro-inflammatory molecules, and other migraine-related chemicals in the brain.5 Recent evidence suggests up to 50 percent of migraine patients have lowered levels of tissue magnesium during an acute migraine attack.6 Another study discovered brain magnesium concentrations were 19 percent lower in patients during migraine attack compared to healthy controls.7 Because recent research strongly indicates a magnesium deficiency in migraine headaches, natural medicine practitioners prescribe magnesium along with other trace minerals as a primary treatment for this condition with great success.

Because of their widespread distribution throughout the metabolic workings of the human body, trace minerals are integral to the functioning of one of the body’s largest organ systems, the muscles. Mainly, magnesium plays a large role in the relaxation of muscles following their contraction. Without this vital nutrient, it would be impossible for the muscles of the human body to function. Muscle cramps are prevalent in western society due to lack of intake of an appropriate amount of minerals. One easy, straightforward cure for muscle cramping is supplementation with magnesium and other trace minerals, as they allow the muscles to function smoothly and correctly. The role of magnesium in relieving cramped muscles also makes it a highly appropriate therapy for the muscle pain associated with fibromyalgia, a condition that is often treated successfully by practitioners of natural medicine. These practitioners often use high doses of magnesium and other trace mineral combinations to reduce the painful and tender muscles that are so common in fibromyalgia patients.

Another condition that is successfully treated with magnesium and trace minerals is Chronic Fatigue Syndrome. People with this condition often experience profound muscle aches and weakness. It has been shown that in order for proper muscle contraction and relaxation to occur, magnesium and calcium need to be present in proper amounts in the body, which can be difficult to achieve even on a standard healthy diet. Additionally, magnesium and mineral supplementation may decrease the pain involved with sports-related injuries and excessive physical activity. As we use our muscular system, it is slowly depleted of these minerals, making replacement a top priority. Others signs of magnesium deficiency include disorientation, depression, tingling, numbness, seizures, abnormal heart rhythms in addition to muscle spasms and cramps.8,9

A minimum of at least 60 trace minerals has been demonstrated to be vital to health and well-being.10 This article has covered only a small fraction of the multitudes of health benefits of trace minerals. As science and natural medicine continues to uncover the many roles for all of these trace minerals, doctors are finding exciting solutions to several maladies that may be successfully treated by replacing these nutrients in the body. Unless we begin replacing these minerals early on in life, we put ourselves at risk for the many diseases of mineral deficiency that are becoming more and more prevalent in society today.

The U.S. Department of Agriculture (USDA) this year issued a new food pyramid aimed at convincing Americans to eat more fruits, vegetables, whole grains, and lean proteins such as dairy, meat and beans. While the USDA publicizes its pyramid with much fanfare, the agency implements policies that subsidize the consumption of nutrition-poor, high fat and processed foods, while offering no incentive to farmers to grow healthful crops.

The Pyramid Versus Farm subsidies

A recent Associated Press (AP) article* contrasted the pyramid recommendations with a breakdown of this year’s $17 billion in direct subsidies to farmers.

  • Corn and feed grains constitute 43% of subsidies. Critics point out that subsidized corn oil used to fry fast food burgers; thickeners and starches for processed food; and corn feed for cattle—which is unsuited for the cow’s digestive system, resulting in illness and reliance on antibiotics.
  • The next most-subsidized food crop are soybeans and wheat (9% each). Soybeans are a source of hydrogenated oil that gives a flaky texture to commercial pastries, and of livestock feed, which further promotes meat consumption.
  • Wheat, while a healthful grain, has become so ubiquitous in our diet that many individuals have developed sensitivities to that staple.
  • Tobacco, with its well-known harmful effects, also receives 9% of farm subsidies.
  • Other food crops receive less than 1% each, and fruit and vegetables receive none.

    Overproduction Leads to Lower Prices

    U.S. farm policy leads to the overproduction of nutrition-poor, fat and starch-laden foods. As a result, the prices of these foods go down, while healthy food remains less affordable.

    A related AP story describes the barriers faced by poor families who would prefer a more nutrition’s diet but end up eating cheap, unhealthy food. Adam Drewnowski, director of the University of Washington’s Center of public Health Nutrition is quoted: “Energy-dense foods rich in starch, sugar or fat are the cheapest option. As long as the healthier lean meats, fish and fresh produce are more expensive, obesity will continue to be a problem for the working poor.”
