With a new bill proposed in California, the state could soon go against the federal marijuana prohibition. The bill would require a court order to take actions against a person suspected of marijuana use. This also prohibits law enforcement from responding to federal request for personal information or providing information on individuals with a license for marijuana. In addition, the bill also prohibits the transfer of an individual to federal law enforcement for anything marijuana related. The bill has been met with some opposition, especially from law enforcement groups, citing it would limit the effectiveness of their job.

Medically prescribed cannabis is being proven to be a good substitute for the standard opiods that are often prescribed to people in pain. Opiods are known to cause dependency whereas medical marijuana does not have that effect on it's users. Studies even find that there are a lot of opiod-related deaths, but this wouldn't be an issue if doctors were more likely to prescribe medical marijuana in these instances. The hope of many medical marijuana users is that it will be removed from the list of banned substances, so that the costs of medical marijuana will soon be covered by health insurance providers. With the new presidency, they hope this will soon be the case.

Activated charcoal has been treated by heat to open up millions of small spaces between the carbon atoms and turn it literally into an atomic sponge that adsorbs both organic and organic impurities.

This heat treatment is carried out in the absence of oxygen, so the charcoal cannot burn. Instead, what oxygen it did contain is driven off leaving behind all of these interstitial gaps that multiply the effective surface area by factors of ten. Since it is the surface area of the charcoal that determines its potency, then the greater this is the better.

Activated charcoal has a massive surface area, and just ten grams has the same surface area as nine American football pitches or 77 tennis Courts. Ten grams is just marginally more than a third of an ounce. The term adsorb has a different meaning to absorb, and while a real sponge absorbs water by mopping it up through capillary action and suction, activation carbon adsorbs substances through a form of chemical attraction. You get rid of water from the sponge by squeezing it, but that doesn’t work with activated charcoal, since the substances are bound to it, not just physically constrained.

This huge surface area provides activated charcoal with innumerable bonding sites, and when chemicals that are attracted to carbon pass by they are attached to the surface. They cannot get free again, as water in a sponge can, but are bound to the surface of the carbon. Because the digestive system has no effect on charcoal then whatever is bound to it passes naturally through the body.

It is most effective at binding other carbon-based materials, and other substances with the right electronic arrangement, but others will just pass straight through. Because it is a chemical process, once all of the empty bonding sites have been taken up, the charcoal loses its effectiveness and has to be replaced. It is possible to regenerate it, but hardly worthwhile for you to do so because of the small quantities you use.

Because of the way it works, activated charcoal can help people to recover from some forms of food poisoning. It can adsorb gases in the intestine and help to relieve the pain of excessive gas in the gut. It has many additional uses that will be touched on later, but for now we will look at its effect on poisons because that is where activated charcoal is of greatest benefit to us.

It does not adsorb and neutralize all poisons, but is very effective with those that it can be sued for. Professor Touery proved a point when he drank a lethal dose of strychnine in front of colleagues at the French Academy of Medicine in 1831 and came through unscathed. He had mixed the strychnine with activated charcoal, and the fact that he lived after drinking a dose that would certainly have led to a very painful death within minutes testifies to the powerful effect of activated charcoal as an potential antidote for poisoning.

Ever medicine cabinet should have an emergency supply of activated carbon, especially those with young children in the household. However, this is not good news for the pharmaceutical companies who have reacted by refuting some of the claims made in its favor: they have claimed that it is not effective against arsenic. If that is so, then how did Michel Bertrand survive after swallowing 5 grams of arsenic trioxide – 150 times what is regarded as the lethal dose? He did this is 1813 after mixing it with activated charcoal, just as Professor Touery was to do 18 years later with ten times the lethal dose of strychnine.

It is true, however, that it does not have this degree of activity with all poisons, and it has no effect on cyanide, alcohols, antifreeze (glycols) and lithium. It also has no effect on corrosive poisons such as the strong alkalis used in oven clearers, or hydrocarbons such as kerosene. The way it works is adsorb the poison and prevent it being released into the body. For that to happen, the poison must have an affinity for carbon, and its adsorption site, and not all substances possess that property. Those that do however are permanently bound and therefore safe.

For charcoal to be effective in neutralizing a poison, it must be swallowed within an hour of taking the poison, or the poison will be too far advanced ion the digestive process for the charcoal to do any good. Keep in mind, though, that it is not selective, and activated charcoal can adsorb nutrients and other beneficial constituents of your body’s chemistry. It is important therefore that you take in only when necessary: you might need several doses if the poison was severe, but once it has done its job it is not meant to be used as a maintenance material to take ‘just in case’. Used like that, it can do harm.

If charcoal can adsorb poisons then it makes sense to believe that it can also adsorb some of the harmful agents that cause food poisoning. Not all food poisoning of Course, but certainly those organisms that emit toxins that are attracted to carbon. And this is, in fact, the case. Food poisoning is caused by bacteria rather than viruses, and is not the presence of the bacteria that make you vomit and feel very ill.

As bacteria grow in your body they release toxins, or poisons, into your digestive system. These poisons are what make you ill. They can seriously affect the complete gastro-intestinal tract, causing vomiting, diarrhea, and inflammation and swelling of the small and large intestine. The latter can cause abdominal cramps and severe colic, and the severity of the symptoms depends very much upon the type of bacteria and the number of them in your body.

Many of these toxins are attracted to carbon since they are frequently organic based, and activated charcoal can be used to adsorb them. Once adsorbed they lose their potency, and since carbon is not digested by the body, they are passed harmlessly through the colon and eliminated in the faeces. It can also be used to eliminate many other foreign bodies from your gut, including viruses and fungi and might possibly reduce the concentration of uric acid, which can bring relief to gout sufferers.

Activated charcoal has many uses, and is normally available in capsule form. It can be dangerous to take too much, particularly if you suffer from intestinal problems that cause constipation, because the charcoal itself can have that effect. However, there is no better emergency treatment for accidental poisoning in the home, although, since it is not suitable for all poisons, you must still regard poisoning as an emergency and contact the emergency services.

Activated charcoal, or activated carbon as it is sometimes called, is also a good emergency treatment for vomiting and the other unpleasant effects of food poisoning. It deals with bacterial toxins in the same way as any other, though once again you must refer to your physician before or after using it – preferably the former.

Supreme Court Refused Ephedra Appeal…The U.S. Supreme Court on Monday refused to consider an appeal by Nutraceutical International Corporation, which sought to overturn a federal ban on the dietary supplements containing ephedrine alkaloids. The Court’s decision, issued without comment, lets stand a 2005 ruling by a federal appeals Court that upheld the Food and Drug Administration’s (FDA) 2004 ban. David Seckman, executive director and CEO of the Natural Products Association commented on the refusal. “Obviously we were concerned about the consequences of the circuit Court’s ruling on the risk benefit standard the FDA used in removing ephedra from the market, which is why we filed our amicus brief. As we clearly stated in the brief, we believe congress did not intend for such a standard to be used. But, since the Supreme Court decides to take up only between five and ten percent of cases brought to it, it is not a shock that they’ve decided not to hear it. We should note, however, that the denial of the Nutraceutical petition is not an affirmation by the Supreme Court that they agree with the lower Court’s decision,” Seckman said. In April, the Natural Products Association had filed a “friend of the Court” or amicus brief with the U.S. Supreme Court that challenged the lower Court ruling on the standard used by the FDA to impose a 2004 ban on ephedrine alkaloids in dietary supplements.

A three-judge panel of the 10th U.S. Circuit Court of Appeals in Denver late last week overturned a 2005 ruling by a Utah district Court that had allowed the sale of low-dosage ephedra dietary supplements containing 10 milligrams or less of ephedrine alkaloids.

The appellate decision, which is effective immediately, supports FDA’s original determination that no dosage of ephedra is safe for consumption and means that it is unlawful to manufacture and sell any supplements containing ephedra, even products containing low doses of the herb.

The original ban was challenged in a May 2004 lawsuit by Nutraceutical Corp, and its subsidiary Solaray Inc., which said dried whole-herb ephedra sinica - the type of supplement in their products – had been safely used for thousands of years.

The U.S. district judge in Utah blocked any enforcement action against Nutraceutical for selling supplements containing 10 milligrams or less of ephedra per daily dose. The Utah District Judge said FDA’s process in banning ephedra improperly shifted the burden of proving product safety from the government to supplement manufacturers.

While noting that the Dietary Supplement Health and Education Act of 1994 (DSHEA) categorized dietary supplements as foods and are not, therefore, subject to premarket approval by FDA, the appellate panel found that the Utah district Court had interpreted this basic provision to narrowly.

The panel said that the Food, Drug and Cosmetic Act (FDCA), of which DSHEA is a part, should not be interpreted “too restrictively” but should instead be read in a manner “consistent with the statute’s overwhelming purpose to protect public health.”

Nutraceutical’s attorney has indicated that the company would appeal the ruling to the full appeals Court.

You may remember the outrageous ruling resulting scandal surrounding Lane Labs MGN3 product back in july 2004. essentially, the FDA forced the company to stop selling the product—not because it was dangerous or ineffective but because the FDA felt that Lane Labs marketing language made disease clams allowed only for FDA-approved drugs.

When that happened, everyone who had experienced great results with this immune system booster (including many HSI members) suddenly found themselves without a safe and effective product they could rely on. So we promised that we would keep a lookout for a natural and effective therapy that would provide similar benefits to the outlawed MGN3 formula.

Bassler of the District of New Jersey, which stated that FDA may demand that Lane Labs pay back every consumer who had bought the company’s top selling products—shark cartilage supplements that were allegedly marketed as treatments for diseases including cancer and HIV. The restitution amount is estimated at 109 million. The appeals Court rejected the argument that FDA cannot demand restrictions because the Federal Food, Drug, & Cosmetic Act (FDCA) does not expressly provide for such a remedy. “Whether or not congress specifically contemplated restitution under the FDCA, the ability to order this remedy is within the broad equitable power granted to the district Courts to further the economic protection purposes of the statute,” 3rd Circuit Judge Marjorie O. Rendell wrote in an opinion joined by Judges Maryanne Trump Barry and Edward R. Becker.

In its appeal, Lane Labs was supported by an amicus brief from the Washington Legal Foundation (WLF, Washington, DC) urging the Court to reverse Bassler’s decision, on the grounds that restitution is not authorized anywhere in the text of the FDCA.

WLF attorneys Daniel J. Popeo and Richard A. Samp, joined by attorney Jeffrey A Lamken of Baker Botts in Washington, DC, argued that the FDCA gives Courts the power to “restrain” violations, but does not allow FDA to seek “Backward-looking monetary relief.”

WLF argued that FDA, throughout most of its history, never asserted a right to seek restitution until recently, when it began asserting that power in order to have “a big club with which to intimidate manufacturers who might otherwise seek to challenge FDA directives,” including large pharmaceutical companies. However, the Court upheld FDA’s authority to seek restitution on the grounds that the FDCA’s grant of authority to restrain violations of the Act should be read broadly to include all forms of equitable relief.

FDA cannot be allowed to get away with this power grab,” said Samp after reviewing the Third Circuit’s decision. “The American economy suffers, and public safety and health are jeopardized, when FDA seeks to exert power beyond its authority, upsetting to delicate balance struck by Congress in its attempt to both preserve the public welfare and enCourage valuable pharmaceutical innovations.” He added that WLF has pledged to continue to litigate the issue and to support Lane Labs in any further appeals the company may file.

CLA and Body Fat

Of all the health concerns facing Americans today, few are as important and daunting as weight loss and body fat. In the 1980s, Americans gained an average of eight pounds each. That’s on the order of 1 million tons of flab—2 billion total American pounds.45 So large is the current girth that as many as two in three Americans could be termed overweight.46 Being overweight and having excess fat increases the risk of heart disease, some forms of cancer and diabetes. That collection of health challenges would be difficult enough, but being overweight has many problems that accompany it, including battles with self-esteem.

Let’s give a historical example of this story. The emotional power of being perceived as too fat is caught with pathos in the life of former U.S. President William Howard Taft. Taft, who is the only man to serve as both president and as chief justice of the Supreme Court, was noted for his honesty and his integrity. The nation mourned his death, but much of his internal story focused on his battle with weight. One editorial cartoonist showed the island of Cuba tipping under his girth. Once, when he visited Japan, an entire village worked together to pull his rickshaw up a hill. When he married, his personal esteem showed when he told his wife that “I shall worry you so much with my appetite that you must gain strength to meet the trial.”

Taft refused to be seen on a horse because of how awkward he looked. At one point, he lost 75 pounds, but, like so many others, ended up gaining that amount back , and more, during the next 10 years. He died of athero s c l e rosis, something associated with being ove rwe i g h t .4 7 The tragedy of Taft is that, like so many suffering with weight trouble, he seemed to let it damage his self w o rth, when he was a great asset to his nation and to others. History and culture put into us that being overweight means lacking in self-control and being a glutton, when in reality this isn’t true. So many more factors are involved. Each person has a different metabolism. Certain nutrients can meet different needs, and a lack of those nutrients can lead to fat retention. CLA may be one of those nutrients, one of those factors in our diets that can change our shapes and that have nothing to do with self-control, just nutritional luck and knowledge. In a study of rats, 28 days after beginning the study, body fat in those that ate CLA was 58 percent less than in those who didn’t consume any (10.13 percent body fat versus 4.34 percent body fat, a highly significant difference). Also, the percent of muscle was about one percent more in animals that ate CLA. The weights of both sets of animals were about the same.48 (Muscle weighs more than fat. This can mean that you won’t necessarily lose weight with CLA, but would gain muscle mass, which is tighter and more shapely.) The research in this area is slightly newer, but it has been reproduced in studies on other animals.49 That more than one kind of animal has shown that body fat is lower with supplements of CLA indicates that it will likely benefit humans as well.

In July 1997, preliminary results of one of the first human studies involving CLA showed promising, preliminary results. For three months in 1997, 20 volunteers participated in a study, daily consuming an amount of slightly more than one gram of CLA at breakfast lunch and dinner. Three months later, their weights and body-fat percents were measured. Half of the group took a placebo. The average weight of the 10 who took CLA dropped by about five pounds (not enough to be statistically significant), but the body fat percentage dropped by about 15 to 20 percent, or from 21.3 percent of average body fat to 17 percent of body fat. Meanwhile, the group taking a placebo had little or no effect on either. Half of the people in the study were men and half were women. Two people in the study decided to drop out because they received unpleasant gastrointestinal upsets. One of those who dropped out was in the placebo group, the other in the group taking CLA.63

Nobody would suggest that CLA supplementation would be a pill freeing you to sit slug-like on the couch to watch M*A*S*H* re runs. A healthy, weight-conscious lifestyle requires many factors including exercise. As far as science can tell, CLA may not be essential the way certain vitamins are. If you consume no vitamin C, you can expect to get scurvy and die. There are no known deficiency diseases associated with an absence of CLA.

Japanese consumers, for example, get very little CLA in their diets, but they also eat food very low in fat, and their lives are among the longest in the world.50 So, the role of CLA supplementation in regulating weight is most useful for those with a typically high-fat Western diet. As the science grows, it seems clear that CLA will lead to better health and more hope for people struggling with body fat.

What's in a name? A headache by any other name hurts just as much. But categorizing your headache can be as overwhelming as finding an obscure breakfast cereal at the supermarket. Medical folks pigeonhole headaches as tension headaches, allergy headaches, morning headaches and sinus headaches, plus the organic, migraine, cluster, trauma, TMJ, eyestrain, rebound, exertion, hormonal and muscle tension varieties. You may also suffer the self-induced hangover and toxicity headaches.

Americans are no strangers to self-medication, and as a society we battle these headaches by consuming nearly 80 billion tablets of aspirin each year, about 20 million aspirins a day, according to Burton Goldberg, co-author of An Alternative Medicine Definitive Guide to Headaches (Future Medicine Publishing). And while we drown ourselves in over-the-counter and powerful prescription products, our tolerance, just like a drug addict's, grows. So what begins as a twodose headache slowly evolves into three, four or five doses, until you realize that no dosage can make your headache go away.

Unless you're fond of medieval practices such as ritualistic healings and bloodletting, drugs seem the only answer to headache misery. But even modern medicine has been unable to solve headaches. Rather than a cure, medications provide only temporary relief, and even that isn't guaranteed. Additionally, over-reliance on medications can lead to chronic head pain. According to Goldberg, rebound headaches often result from the consumption and withdrawal of drugs.

Halt Your Headaches

Rather than strive to simply eliminate headache pain, why not identify the underlying cause and prevent the headache? Almost always, every type of headache results from a health or lifestyle-related activity. In an ideal world, the best approach would be to eliminate the tensions, stress, frustrations, anger, insufficient sleep, excessive drinking and poor diet that contribute to your headaches. For better or for worse, however, you can't always: a. quit your job; b. ask your spouse to leave; c. sit on the beach all day; or d. all of the above. But you can make appropriate lifestyle changes and learn to express suppressed feelings.

This approach, lifestyle modification, is a treatment program based on a Loma Linda University study, originally published in Medical Hypothesis and the Journal of Women's Health and Gender-Based Medicine and later explained in No More Headaches, No More Migraines: A Proven Approach to Preventing Headaches and Migraines by Zuzana Bic, DrPH and L. The program, conducted on a group diagnosed with chronic migraines, dramatically decreased the frequency, intensity and duration of headaches in nine of 10 headache sufferers. Rather than demand radical life changes, the lifestyle modification program introduces gradual changes in three specific areas: nutrition, exercise and understanding stress. The study doesn't expect you to change your entire diet, join a gym and eliminate everything that triggers stress, but teaches techniques to make subtle lifestyle changes and reduce the impact of daily stress. These same techniques can also improve sleep patterns, a factor known to affect headaches. The lifestyle modification approach clarifies that while very few headaches directly result from existing acute conditions, recurring headaches often derive from a larger lifestyle factor. If these issues are ignored, the body's natural defense mechanisms may kick into overdrive and become exhausted, leaving you susceptible to other chronic diseases. By finding and eliminating the cause of your headaches, you may be saving yourself from other eventual illnesses.

Natural Alternatives

For simple headaches, start with relaxation and neck stretches. Or try rubbing your forehead with peppermint oil, a natural antispasmodic and diuretic shown in German research to be as effective as acetaminophen in easing tension headaches.

Never underestimate the old-fashioned ice pack to the forehead as an effective treatment that works by constricting the swollen blood vessels that cause your head to ache. If the ice pack isn't enough, try putting your arms in icy water up to your elbows to constrict additional blood vessels. But if it's a sinus headache you're fighting, take the opposite approach and try hot compresses.

The herbal, and original, form of aspirin is white willow bark. Used by Chinese practitioners 2,500 years ago, it contains salicin, nearly the same pain reliever found in aspirin. Other herbal aspirins include meadowsweet tea, just as effective as aspirin with few side effects. For migraines, Walker and Brown recommend feverfew and magnesium supplements, which reduce nerve excitability and migraine susceptibility. In fact, individuals with frequent headaches have been found to have low brain and tissue magnesium, says Julian Whitaker, MD, author of Julian Whitaker's Guide to Natural Healing (Prima). For all headaches, Goldberg suggests essential fatty acid supplementation with evening primrose oil (EPO), which improves circulation, helps regulate inflammation and relieves pain.

The Curse of the Migraine

Migraines, a debilitating headache distinguished by a throbbing pain, may be humanity's oldest malady. The name is derived from the word the Greek physician Galen used to describe the disorder in 200 A.D. Six-thousand-year-old Sumerian writings refer to the ravages of migraines, and prehistoric skeletons bear testimony to a crude form of trephination-holes chiseled in skulls to allow the escape of pain-creating demons, according to Lifetime Encyclopedia of Natural Remedies by Myra Cameron (Parker Publishing).

In the common migraine, throbbing pain develops gradually from distended veins around the brain and may be accompanied by nausea, vomiting and sensitivity to light. These miseries can be preceded by 15 to 90 minutes of an "aura," which includes visual disturbances, distorted perception, hallucinations, flashes of light and temporary loss of sight or hearing. In fact, skeptical historians attribute some of the religious visions of the Middle Ages to the visual effects of migraine aura, according to Cameron.

Snacking on high fiber foods between three light meals each day helps stabilize blood sugar and prevent migraines. And while some doctors summarily attribute migraines to diet, other experts attribute at least half of all migraines to food sensitivities. The most common edible villains are aged cheeses, yeast breads, chocolate, cured meats, citrus fruits, eggs, fermented foods, wheat, milk, milk products, alcoholic drinks and food additives, including nitrates and MSG.

Suggested daily supplements for migraine-susceptible individuals include a multivitamin, one capsule of B complex to help maintain normal vascular control, 3,000 to 6,000 milligrams in divided doses of vitamin C with bioflavonoids to assist the production of anti-stress hormones, and 500 to 1,000 milligrams of magnesium to reduce nerve excitability and pain. At the onset of a migraine, says Cameron, try homeopathic remedies, dilutions of natural substances from plants, minerals and animals. For throbbing pain, take natrum muriaticum according to package directions. Other homeopathic options to explore include iris versicolar, lac defloratum and sanguinaria.

Take Charge of Your Headaches

Headache management involves managing your life. Practice relaxation techniques to reduce stress. Calmly discuss your feelings. Take a leisurely stroll at lunch. Walk your dog, or a neighbor's dog, after dinner. Keep a food diary. Sit and stand tall. Skip the fast food tonight. Join a yoga class. Take vitamins and supplements. Get a two-hour massage. Turn the television off earlier and sleep in a little later.

Taking the time to care may take effort, but it will soon become second nature. Invest in yourself. It's your most precious possession.

The principles of homeopathy are elegantly basic and, to some, maddeningly elusive. This system of medical treatment employs The Law of Similars or "like cures like," and calls on natural plant, animal and mineral substances that induce the body to heal itself.

That homeopathy works is virtually incontrovertible. With its ancient roots and European practice spanning hundreds of years, homeopathy employs minute doses of diluted extracts to replicate symptoms of a malady, which then vanishes. But the very fact that it works puzzles many experts who have researched the phenomenon.

Understanding The Tradition

Homeopathy evolved from its earliest practice recorded by 10th-century BC Hindu sages to its codification by Hippocrates in 400 BC. " Through the like, disease is produced and through the application of the like, it is cured," he wrote, expressing the fundamental principle of homeopathy, according to Homeopathic Medicine at Home (Tarcher Perigee) by Maesimund B. Panos, MD, and Jane Heimlich. Samuel Christian Friedrich Hahnemann, the erudite and intellectually audacious German physician and chemist, seized upon the essentials of homeopathy in the early 1800s.

Through Hahnemann's work, homeopathy developed into an intricately systematized science, veering into the arcane for the contemporary individual seeking relief for everyday ailments.

Modern practitioners and manufacturers of homeopathic remedies benefit from Hahnemann's daring research (which included potentially lethal experiments on himself) and complex doctrines.

They've streamlined and modernized Hahnemann's concepts to provide more relevance to modern ills and sensibilities.

The Bold Experiments

Hahnemann denounced the medical practices of the 18th century, which involved cauterizing, bleeding, blistering and purging patients to expel the pernicious fluids or humors believed to cause disease.

He also reviled the kind of omnibus prescription drugs of the day, which loaded many substances into one compound. In 1790, Hahnemann conducted his groundbreaking experiment establishing the basis of homeopathy.

The customary treatment for malaria at the time was Cinchona officinalis or Peruvian bark-quinine. Medical wisdom attributed its efficacy to its bitterness and astringency. Hahnemann rejected this explanation, noting that other botanicals are far more bitter and astringent, yet are powerless against malaria.

To prove his theory, Hahnemann took some cinchona compound and promptly developed the symptoms of malaria. His deduction: Like cures like, or The Law of Similars. A substance that, in minute doses, induces certain symptoms in a healthy person cures a sick one.

The Set of Laws

A set of fairly complex laws developed from Hahnemann's initial Law of Similars.

The Law of Proving refers to the process of ascertaining the effectiveness of a homeopathic therapy by administering a substance to a healthy person to record in minute detail its effects. Practitioners also use the standard double-blind method using a placebo or unmedicated tablet against a homeopathic compound.

The first proving was performed in 1790 and the procedure endures today, using only humans, not laboratory animals, for greater accuracy. As homeopathic preparations are not toxic, proving has never produced lasting adverse reactions. Descriptions of provings are compiled into books called materia medicas, including Boericke's Materia Medica and Repertory and The Lectures of Homeopathic Materia by James Tyler Kent, used regularly in contemporary practice.

The books are highly indexed collections of symptoms and the remedies that cure them called repertories. The most extensively used repertory is Kent's Repertory of the Homeopathic Materia Medica.

In 1800, the third Law of Potentization was devised, regulating the processing of homeopathic remedies through successive dilutions and shaking.

This law represents perhaps the profoundest mystery of homeopathy and demands the boldest leap of faith: The higher the dilution, the more intense the potency of the medicine. Substances that are inert in their natural state act as medicine. And as they are so dilute, homeopathic remedies do not act directly on the tissues, accounting for their non-toxicity. Adding to the inherent safety of homeopathic therapies is the discipline's adherence to the single remedy. Centuries ago, homeopaths seemed to have been prescient about current drug interaction troubles.

How It Works: The Vital Force Homeopathy embraces a philosophy centered on the concept of "vital force," an intelligent, dynamic life force within each individual responsible for maintaining one's life and balance on all levels. The vital force creates a defense mechanism similar to the immune system, but incorporates protection against imbalances on the emotional and mental planes as well.

Homeopathy equates disease with imbalance. As the defense mechanism attempts to restore balance, symptoms appear: pain, swelling, rashes and fevers on the physical side; grief, jealousy, anxiety, anger, confusion and loss of memory on the emotional and mental end.

Homeopaths regards these symptoms as evidence of the vital force's curative exertions, not merely annoyances to be eliminated. Symptoms guide the homeopath in his or her attempts to harmoniously augment the efforts of the vital force.

Homeopathy Today

Homeopathic remedies are prepared according to the standards of the United States Homeopathic Pharmacopoeia and are recognized by the US Food and Drug Administration. " Homeopathy respects the complexity and uniqueness of each individual," observes pharmacist and naturopathic doctor James LaValle (and his co-authors) in Smart Medicine for Healthier Living. "To identify the correct homeopathic remedy, you must carefully observe your unique-even quirky-behaviors and responses." Indeed the emphasis on the "unique, even quirky" may lead to the perception of homeopathy as a sketchy pseudo-science. Homeopathy simply does not fit the drug model of allopathic medicine.

Its ability to help people, however, has been repeatedly evaluated through rigorous scientific research. A comprehensive review in the British Medical Journal (302, 1991: 316-323) of more than 100 clinical studies of homeopathy published during the last 30 years revealed that 77% of those studies produced positive results for the people involved. A host of additional studies provides clinical evidence:

  • • A fixed combination of three plant substances (Phytolacca americana, Guajacum officinale and Capsicum annuum) significantly decreased the symptoms of acute tonsillitis in 107 sufferers, who took no antibiotics. The anti-inflammatory, immunomodulatory and analgesic properties produced no side effects (Adv Ther 15, 1998: 362-71).
  • • An article in the Journal of Nurse Midwifery (44, 1999: 280-90) explains the use of 19 homeopathic remedies that aid breastfeeding.
  • • "The practice of (homeopathic) preventive antepartum care of pregnant women, adopted at the beginning of this century, has reduced perinatal mortality and the rates of low birth weights and preterm weights. . .Studies on homeopathic interventions in obstetrics report positive influence of homeopathic remedies on uterine contractility and the evolution of childbirth. The only study comparing homeopathic and conventional therapy in women with increased risk for contraction abnormalities found few differences between the treatments, except fewer hemorrhages and decreased abnormal contractions in patients treated with homeopathic remedies (Schweiz Med Wochenschr Suppl 62, 1994: 28-35).
  • • A homeopathic remedy proved as effective as prescription betahistine hydrochloride in treating folks with vertigo (Arch Otolaryngol Head Neck Surg 124, 1998: 879-85). n Single, individualized homeopathic remedies demonstrated potential efficacy in HIV infection during its symptomatic period (Br Homeopath J 88, 1999: 49-57). The remedies produced a "statistically significant" elevation in base line immune status.
  • • And, finally, a study in the prestigious international medical journal The Lancet (September 20, 1997) claimed that researchers' findings and conclusions "are not compatible with the hypothesis that the clinical effects of homeopathy are completely due to placebo" but called for more "rigorous. . .systematic" research on homeopathy.

    Federal Court Overturns FDA Ban on Ephedra at Low Doses

    A Utah Federal District Court recently limited the scope of a year old Food and Drug Administration’s (FDA) Final Rule1 banning the sale of all ephedrine-alkaloid dietary supplements.2 The Court’s ruling has a limited affect on the ability of companies to sell ephedrine nationally, but is important regarding FDA procedure for creating rules and enforcement powers. Ephedrine alkaloids are found primarily in the controversial herb ephedra (Ephedra sincica Stapf., Ephedraceae).

    The District Court determined that the FDA’s use of a risk-benefit analysis was against the intent of Congress in passing the Food, Drug and Cosmetic Act,3 which presumes all foods are safe and requires the FDA to prove the existence of a significant or unreasonable risk. The Court held that to require food producers to establish a benefit before selling their product places an improper burden on them and was inconsistent with Congress’s intent when it passed the Dietary Supplement Health and Education Act of 1994 (DSHEA) to clearly place the burden of proof of safety of a dietary ingredient on the FDA.4

    Secondly, the Court determined the FDA had to show by a preponderance of the evidence “a significant or unreasonable risk of illness or injury.”5 Therefore, in order to ban all sales of a given product, the FDA must first prove that the dosage amount in the product presents an unreasonable risk.6 Prior to this ruling, the FDA was not required to consider dosage size before banning a substance.

    This ruling has limited effects at the moment since the FDA may appeal this decision. Additionally, the ruling has no effect on the laws of several states (including California, Illinois and New York) which have banned all sales of ephedrine alkaloids in dietary supplements. The ruling also only applies to products containing 10 mg or less of ephedrine alkaloids per daily dosage. Any product exceeding that amount is still banned and will continue to be enforced under the FDA rule.7

    The Court, in its ruling, specifically precluded the FDA from taking any enforcement action against Nutraceutical Corporation, the company that filed the lawsuit, for its sale of products containing 10mg or less of ephedra and for the FDA to consider further rulemaking “consistent with this Order”.8 However, the Court did not specifically instruct the FDA to refrain from taking enforcement action against other brands containing less than 10mg of ephedrine.9 As such, companies considering launching new products containing ephedrine alkaloids are advised to do so carefully.

    Nutraceutical Corporation president Bruce Hough was cited in The New York Times as saying that the company’s reason for filing the suit was not based on ephedra and that his company had no plans to begin marketing ephedra supplements in the near future.10 Hough was quoted as saying, “We filed it [the lawsuit] because the FDA established rules that could cause problems to the rest of our business.” Hough was referring to the legal basis upon which the FDA banned the sale ephedra. He told the American Botanical Council that the FDA was applying a drug standard of risk vs. benefit to herbs and dietary supplements – technically foods under the law. [Hough B. Personal communication to M. Blumenthal, Apr. 27, 2005.] His company filed the lawsuit in an attempt to deter FDA’s new procedure for creating what he considered arbitrary rules which contradict the plain meaning of existing federal law (DSHEA).

    The American Herbal Products Association (AHPA) issued a statement on April 26 clarifying its policy on the sale of ephedra in dietary supplements.11 AHPA has notified all its members that at this time it is the organization’s policy that none of its members should be selling low doses (10 mg or less) of ephedra in dietary supplements until the FDA has clarified its position on the Court decision. At this time it is not clear whether FDA plans on appealing the decision or will implement the new policy set by the Court.

    The Court decision does not affect the sale of the herb ephedra in traditional formulations intended for use that is consistent with traditional uses, e.g., pulmonary complaints, and are dispensed by licensed healthcare practitioners.

    As might be expected, Court’s decision has stimulated a new round of media and congressional criticism of the relative safety of herbs and dietary supplements as well as DSHEA. For example, a highly critical article by Chris Mooney was posted on the website of the American Prospect on April 25.12 The Prospect is relatively influential in Democratic and progressive political circles in Washington. The article uses language such as the Court decision is a “scandal” and a “disturbing ruling”, refers to DSHEA as “a terrible law” and a “peculiar and misguided law” and the “wrongheaded standards encoded in the DSHEA”, and repeats the often-cited media mantra about “unregulated herbal supplements” and that the “FDA has been hamstrung and effectively rendered impotent.”

According to the Nutrition Desk Reference, the amount of Molybdenum required daily for people is 100 mcg to 500 mcg. It also states that the amount of Molybdenum in food can vary tremendously, depending on crop soil levels. Low levels are not at all uncommon, and they are lessened even further by commercial farming practices that utilize synthetic fertilizers which do not put Molybdenum back into the soil. The result? The typical American diet does not provide adequate Molybdenum. They sued not just to protect their ephedra product, but to protect your access to other supplements. Why did they sue and what does this mean for you?

    Why did Nutraceutical challenge FDA's actions?

  • We wanted to make sure the FDA followed DSHEA (The Dietary Supplement Health And Education Act) and uses sound science to stop the sale of ingredients at dose levels that cause harm.
  • We were concerned about a new concept -- a "Risk-benefit" test -- that caused all supplements to be treated like drugs and gave FDA the power to ban any dietary supplement at its discretion.
  • Dietary supplements should not be treated like drugs. Supplements are typically natural food products. Treating them like drugs -- with pre-market approval and clinical studies required -- would mean an end to consumer access to supplements.

  • Why did FDA Ban Ephedra?

  • Over eighty years, FDA proposed, withdrew and re-proposed limits on dietary supplements with ephedrine alkaloids. Until the final rule, all the proposed rules exempted low-dose ephedra products.
  • During those eighty years, FDA took few actions against manufacturers who sold high-dose ehpedra. The Result? Negative and often inaccurate publicity surrounding ephedra supplements.

  • Under DSHEA, dietary supplements are to be regulated as foods.

  • FDA's "risk-benefit" test is contrary to what Congress intended when they passed DSHEA in 1994.
  • To ban a dietary supplement, FDA must establish that the specific dose recommended in the label presents a significant or unreasonable risk of illness or injury. FDA didnt do that for low-dose ephedra. FDA cant stop Nutraceutical and Solaray from selling their low-dose ephedra product.
  • FDA has to rewrite its Ephedra rule.
  • How does the Decision affect me?

  • The Courts rulling protects your access to dietary supplements. FDA cant arbitrarily ban them.
  • The ruling requires FDA to pay attention to dosage in determining if a supplement is dangerous.
  • The rulling prohibits FDA from Treating dietary supplements like drugs -- it must treat them like foods, as DSHEA specifies.
